It'd be kind of hilarious if all those big corp CEO moguls who love clamoring for less regulations and minimal government tasted their own poison by all patent laws and trademark protections being revoked...
They ask for less regulation because they are the ones who want to be in control and dictate other people's lives, private companies are much more difficult to sue and get them accountable for their actions than the government, and they know it.

Do not give in to the demands of moron corporate overlords like Tim Sweeney. Do not view the world like they do: everything is dark no matter how much money you have.
If the game devs care about their game or are passionate about their craft, they'd be more interested than the player to make their games run on as many platforms as possible.
We have literally game pirates talking about installing Linux and testing their "crack" with Wine to make sure it runs in there as well xD! Literally.
How is this possible that a "cyber criminal" (depending on which region you live) cares more about the player experience than the actual game developers? It absolutely is not the case, it is because morons like Sweeney are in control.
If we give in to the demands of Epic and other companies, we would end up turning GNU/Linux into Android in terms of methodology, because that would mean that app developers would be able to restrict where their apps can run within the Linux ecosystem, in the same way that the companies behind banking apps block the use of their applications on rooted devices and custom roms.

Plus that would set a very serious precedent not only for Linux but for desktop operating systems in general, as it could pave the way to the creation of walled gardens that circumvent anti-trust laws. And both Apple and Microsoft would follow the same steps afterwards.

No, because it goes against antitrust laws, since it is creating a de facto monopoly within a platform where the hardware vendor has an unfair advantage against any potential competitor, that is why Apple lost, and if another relevant company starts to complain and sue the vendors of traditional video game consoles can use that case as a precedent and/or to support their arguments.

Sony and Nintendo fiercely protect that because there are much greater dangers than what piracy can hypothethically cause, and these dangers are called third-party storefronts with better conditions for both developers and users, including lower commission fees, and this is precisely because that It is legitimate competition. Also keep in mind that Nintendo, Sony, and Microsoft make their profits from all games and apps sold in their respective stores. This is nothing new, any company is going to protect its monopoly, and obviously that's something they have no right to.

EULAs are still contracts, and not everything said in a EULA can be enforced, and contracts that involve illegal activities are void. Certainly private monopolies are one of them.

How funny would it be if the next Nintendo console actually uses Yuzu for backward compatibility... and then the FSF sues them for not releasing the code changes...
If Tropic Haze gave up the rights to Yuzu and its source code to Nintendo, Nintendo can relicense it to a proprietary license since the Yuzu project had a CLA, but that would not be retroactive.
But if Nintendo starts using community contributions licensed under the GPL they could get into serious trouble.

However, the tracking of potentail GPL violations would not only be for Yuzu but in general, although Nintendo has respected open source licenses, it is possible that they have violated some at some point in their history, and currently with such an aggressive stance they are more prone to make mistakes. And since there are not yet many precedents set around copyleft licenses, winning such a case would be a great victory for the free software and open source movements.

Ye, but if Microsoft decides to go against Wine, they won't have an easy time, because Valve will support them in that hypothetical lawsuit, their support is guaranteed for obvious reasons.
But that would be getting too far ahead, right now Nintendo of America hasn't even proven any of the actions they attribute to Tropic Haze, some of the accusations are completely ridiculous and are actually Nintendo's fault, such as the continued leaks of their own games before launch.

Everyone should keep in mind this, if Nintendo wins this case it would set a pretty serious precedent and not only for the emulation scene, it would also affect even compatibility layers like Wine, imagine Microsoft taking down Xenia and Wine claiming to "defend their intellectual property" and without anyone being able to do nothing about it, killing any vestige of competition for desktop operating systems in the process as well as getting rid of the Steam Deck (something Nintendo will be pretty happy about too).

No, the exceptions and exemptions of the DMCA wouldn't be much useful there, at that point it is to be expected that these companies will put pressure on the US government to abolish them, companies with this kind of behavior are infamous for molding the legal system to their own benefit, as happened with the Disney and Mickey Mouse case.

The GPU I have is a kepler-based graphics card, which is about to be discontinued by NVIDIA, it is literally going to have a higher lifespan on Windows than on Linux due to the transition to Wayland, since the proprietary drivers for this graphics card have already entered the legacy branch for a long time, which is ridiculous, the planned obsolescence caused by proprietary drivers is alienating.
