Nintendo likely won't be happy about this one, so get it while it's hot, Super Mario Bros Remastered is out now and open source. It doesn't actually include the original assets from the classic Nintendo games, so you need to supply that yourself with a ROM. That might keep it out of reach for Nintendo lawyers, but probably not.
Anyway, this open source fan project is free, open source and made with Godot. So could even be a nice way for others to learn to hack away with Godot to make something. Or just, play Mario on PC.

This game does not include the actual Nintendo game data and requires you to provide your ROM so it's as clean as all the decompilation/recompilation ports we've been getting for N64 games recently. Unlikely Nintendo can do much unless you actually try sending over the game with the ROM.
