If they infringe on copyright, it doesn't really matter if they receive donations or not (also it's not mandatory). Either they do infringe or they do not. But, unless they copied bits from the Switch or other Nintendo work, they don't.
Someone may say they circumvent DRM but I'm not sure I agree with that because if you're using your own dumped keys and your own dumped bought game, are you really circumventing something? Of course things change if they were bypassing something without the need for you to have the legally owned unlocking key.
We also have to remember that emulation is legal according to Sony Computer Entertainment, Inc. v. Connectix Corp. [External Link]. Also, reimplementation of APIs is legal as well (Google LLC v. Oracle America, Inc. [External Link]).
Of course, these cases are all about the US. Other Countries may have different rules (in Europe should be mostly the same, I think?).
The issue is: are those emulator devs really want to dispute against Nintendo in Court?
Nintendo has billions of dollar of "war chest" available to use and those devs most surely don't. Why would they risk losing all they have?

I'm afraid this is gonna blow up and it will be something very frightening for us gaming on Linux.
If a user requests a refund, who is gonna pay? R*? But they are not officially supporting Linux... Valve? But they're going to refund you out of its own pocket.
If R* is forced to pay you back, they may sue Valve for allowing people to run a software in unintended ways...

You might want to avoid the Nvidia 375.20 driver, Nvidia recommend downgrading

375.20 is completely broken for me (GTX 970)...
With KDE:
I can't launch two OpenGL apps at the same time (the second hangs)
(blender + blender, Steam + some games like DE:MD, Mad Max, etc...)
KDE hangs itself when showing the lockscreen / shutdown window...
Basically, with KDE, the system is unusable...
With cinnamon things go better:
I can launch games from steam but for example: DE:MD runs horribly (~1 FPS?)
Downgraded to 375.10...
I guess I'll wait 375.30... :( :><:

@VdoP no, I think when you activate a game on Steam via the CD-key it doesn't count as anything (since you have already paid the game)...
Rocket League is still coming to Linux, but there is no release date
