I don't only remember that, i know they lost that suit. There is Legal precedent hence why they are accepting refunds otherwise they would be liable for a similar lawsuit which they would lose asap since this is clear cut the same thing.

Timmy will keep doing this though he learned the hard way many of this bs after Microsoft slap him in the face a couple of times. Valve needs to do the same, smack him into oblivion, may he will go and pick another personal fight against EA or ATAVI.

Ahhhh that explains a lot. They've chosen to go with the more Expensive and at this point in time riskier target, quite possibly believing there are more moneys to be made there, won't blame them since that is generally the case.
IMO on consoles this game is DOA, they're aiming a bazooka at their foot with this move.

The 2nd one was released for PC, but surprise, surprise Vista only. There are(were) patches to make it run on XP and 7, no idea about how well it works for newer Win versions or Wine.

I and a friend would beat the game at least twice in each difficulty in some sort of speed running craze.
IF they add offline split screen they may ignite my nostalgia flame, otherwise i am on the same boat as you, plus i know even without checking they won't.
