I've played Diablo 3 ín Wine for quite a long time and I never got banned. I'm not saying it couldn't happen, but it seems rather rare and I haven't heard of anyone that has gotten banned over the past six months. To be safe you should use an up-to-date Wine version when playing it.

I'd say the performance is really close to Windows with Diablo 3. Framerates are good throughout the game and there haven't been any noticeable bugs. Sometimes my connection got dropped, but that was only a minor issue and it didn't happen all that often.
