Well, that's exactly what they did with DX10 and DX11 (available only for Windows Vista and newer). And as most of you probably noticed, they really want everyone to use the latest version of their system ;)

This game is a lot like Sid Meier's Pirates! or Sea Dogs, so I'd definitely like to play it :)

Yup, looks like it's broken but I believe they will be able to sort this out soon :) I reported the bug on forums and using their ticket system.

Anyway, the game is pretty good and I definitely recommend it!

It's incredibly cool and fun, but short (2 to 3 hours currently, with more content to come in future update). Overall, a worthy purchase, I had great time playing through this one :)
